  1. General
    • 1.1. These terms. Welcome to wabu.com (Website). We are an initiative launched by Kitmo SAL related to online purchasing of concept furniture (Product(s)), subject to the conditions set out below (Conditions). Please take a few minutes to review these Conditions. These Conditions apply to your access and use of our Website. Your use of our Website constitutes your agreement to follow these Conditions and to be bound by them. If you do not wish to be bound by these Conditions, do not access or use our Website.
    • 1.2. What these terms cover. These are the terms and conditions on which we supply our Products to you.
    • 1.3. Lebanon is our country of domicile.
  2. Information on how to contact us
    • 2.1. How to contact us. You can contact us by calling our customer service team at +961 71 521 218 or by writing to us at info@getwabu.com.
    • 2.2. How we may contact you. If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.
    • 2.3. "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
  3. Our contract with you
    • 3.1. How we will accept your order. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.
    • 3.2. Registration and Password. When you register with or log into our Website, you will need to use a user name and password (User ID). You are solely responsible for maintaining the confidentiality of your information and password. You are responsible for all uses and activities that occur under your password, regardless of whether they are authorized by you. You agree to immediately notify us of any unauthorized use of your registration or password. We will not be liable for any loss or damage arising from an unauthorized use of your registration or password.
    • 3.3. If we cannot accept your order. If we are unable to accept your order, we will inform you of this and will not charge you for the Product. This might be because the Product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because a credit reference we have obtained for you does not meet our requirements, or because we have identified an error in the price or description of the Product
    • 3.4. Your order number. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.
  4. User Conduct and information
    • 4.1. User Conduct. You agree that you will not violate any law, contract, intellectual property or other third-party right or commit a tort, and that you are solely responsible for your conduct, while accessing or using our Website or any third-party platforms where we have an official presence (such as Facebook, Twitter, Instagram, Pinterest and YouTube). You agree that you will abide by these Conditions and will not:
    • 4.1a. Transmit any information, data, text, images, files, links or software through the Services, except as authorized by us.
    • 4.1b. Use or attempt to use another member’s account without authorization from such member and Wabu.
    • 4.1c. Use the Website in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Website or that could damage, disable, overburden or impair the functioning of the Website in any manner.
    • 4.1d. Introduce to the Website any viruses, worms, Trojan horses and/or harmful codes.
    • 4.1e. Obtain unauthorized access to any computer system, including, without limitation, access to any API that may be provided by Wabu in a manner not authorized by us.
    • 4.1f. Attempt to circumvent any content-filtering techniques we employ or attempt to access any feature or area of the Services you are not authorized to access.
    • 4.1g. Transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation.
    • 4.1h. Invade the privacy or violate any personal or proprietary rights, including intellectual property rights, of any person or entity.
    • 4.1i. Conduct fraudulent activities.
    • 4.1j. Collect or harvest information regarding other users of the Products for any reason whatsoever, including, without limitation, for sending such users unsolicited commercial email.
    • 4.1k. Abuse special discounts, awards or incentives offered by Wabu (unless otherwise specified, only one offer is valid per person, with a maximum of two per household).
    • 4.1l. Use any robot, spider, crawler, scraper, script, browser extension, offline reader or other automated means or interface not authorized by us to access the Website, extract data or otherwise interfere with or modify the rendering of Service pages or functionality.
    • 4.1m. Bypass or ignore instructions contained in the robots.txt file, accessible at http://wabu.com/robots.txt, that controls all automated access to the Services.
    • 4.1n. Use the Website for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates these terms and conditions.
    • 4.1.o. Minors under the age of 18 shall are prohibited to register as a User of this website and are not allowed to transact or use the website. 
    • 4.2. User Information. You will be required as part of your registration for the Website to provide Wabu with certain information about yourself, including, without limitation, a valid e-mail address (your Information). In addition to the terms of any privacy policy posted on the Website, you understand and agree that Wabu may disclose to third parties, on an anonymous basis, certain aggregate information contained in your registration Website. Wabu may gather information and statistics collectively about all users of this Website which may include the information supplied by you which helps Wabu understand you. All data shall be in aggregate form only and is intended to help Wabu determine what is most beneficial for you and how to continually improve Wabu’s online service. Wabu may share this kind of aggregate data with selected third parties to assist with these purposes. Personal data is processed by Wabu in accordance with its Privacy Policy.
  5. Our products
    • 5.1. Products may vary slightly from their pictures. The images of the Products on our Website are for illustrative purposes only. Although we have made every effort to display the colors accurately. We cannot guarantee that a device's display of the colors accurately reflects the color of the Products. Your Product may vary slightly from those images. We take great pride in the individuality of each of our Products and although we have made every effort to be as accurate as possible, because our Products are handmade and highly individualized custom pieces, the accuracy of the Products cannot be guaranteed.
    • 5.2. Product Description. Our Products are designed for an intended use of wooden home and garden furniture that is ready to assemble. Wabu believes that the highest quality of material and the highest standard of manufacturing are key to your satisfaction. Because we want you to enjoy the warmth and beauty that comes with using the Product, here are few items that you should be aware of before using the Product:

** The Product is made of reclaimed wood which is a natural product that may contain certain aged characteristics including but not limited to: color variation, nail holes, mortise holes, insect holes, staining, tapering, wane (not squared) etc. Reclaimed wood dimensions will not necessarily be as exact as using brand new timber, therefore the dimensions on the finished product can vary slightly. Appearances of reclaimed wood can also vary from board to board even when sourced at the same time from the same venue.

  • 5.3. Product Considerations. Although every care is taken to ensure our Products are able to handle temperature and humidity changes, the conditions of your home can affect the Product. We advise you to keep the Product in consistent, stable conditions to minimize the effects of temperature and moisture change in the atmosphere. For example, avoiding placing the Product close to a heat sources such as a radiator or oven will go a long way to ensuring the longevity of the Product. Products from the “Elm wood collection and the “Black Edition” are made for indoor use only.
  • 5.4. Product liability disclaimer. Being previously used and worked wood, the possibility of decay or fungus can exist. We endeavor to ensure that the Product is of suitably high quality, but it is impossible to eliminate all the risks associated with using reclaimed wood.
  • 5.5. Product packaging may vary. The packaging of the Product may vary from that shown in images on our Website.
  1. Our rights to make changes
    • 6.1. Minor changes to the Products. We may change the Product:
      • to reflect changes in relevant laws and regulatory requirements.
      • to implement minor technical adjustments and improvements resulting from the individuality of the Products.
    • 6.2. More significant changes to the Products and these terms. In addition, as we informed you in the description of the Product on our Website, we may make the following changes to these terms or the Product, but if we do so we will notify you.
  2. Providing the Products
    • 7.1. Delivery costs. The costs of delivery will be as displayed to you on our Website.
    • 7.2. When we will provide the Products. During the order process we will let you know when we will provide the Products to you.
    • 7.3. We are not responsible for delays outside our control. If our supply of the Products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay we will contact you.
    • 7.4. Collection by you. If you have asked to collect the Products from our premises, you can collect them from us at any time during our working hours on weekdays (excluding Saturdays, Sundays and public holidays) any time between 8:00 a.m. and 5:00 p.m. from Kitmo, located on the first floor of the “Spaces" building, Mkalles main road, Industrial area, Lebanon.
    • 7.5. If you are not at home when the Product is delivered. If no one is available at your address to take delivery, we will leave you a note informing you of how to rearrange delivery or collect the Products from our premises. We may charge you for storage costs and any further delivery costs.
    • 7.6. If you do not re-arrange delivery. If you do not collect the Products from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from our premises, we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract.
    • 7.7. When you become responsible for the Products. The Product will be your responsibility from the time we deliver the Product to the address you gave us or you collect it from us.
    • 7.8. When you own Products. You own a Product once we have received payment in full. Title to, and the risk of loss for, all Products pass to you upon delivery to you.
    • 7.9. Cancelling an Order. You may cancel your order as long as your request is made within 24 hours of completing your purchase, provided that you have not yet received a shipment confirmation from us. In the event your order has already shipped, you may initiate a return in to our Shipping and Return policy.
    • 7.10. What will happen if you do not give required information to us. We may need certain information from you so that we can supply the Products to you, for example, your shipping address and payment information. We will contact you to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may either end the contract or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for supplying the Products late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.
    • 7.11. Reasons we may suspend the supply of Products to you. We may have to suspend the supply of a Product to:
      • deal with technical problems or make minor technical changes.
      • update the Product to reflect changes in relevant laws and regulatory requirements.
    • 7.12. Your rights if we suspend the supply of Products. We will contact you in advance to tell you we will be suspending supply of the Product, unless the problem is urgent or an emergency. If we have to suspend the Product, we will adjust the price so that you do not pay for Products while they are suspended.
    • 7.13. We may also suspend supply of the Products if you do not pay. If you do not pay us for the Products when you are supposed to, we may suspend supply of the Products until you have paid us the outstanding amounts. We will contact you to tell you we are suspending supply of the Products. We will not charge you for the Products during the period for which they are suspended. As well as suspending the Products we can also charge you interest on your overdue payments.
    • 7.14. The cardholder must retain a copy of transaction records and Merchant policies and rules.
  3. Our rights to end the contract
    • 8.1. We may end the contract if you break it. We may end the contract for a Product at any time by writing to you if:
      • you do not make any payment to us when it is due.
      • you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Products.
      • you do not, within a reasonable time, allow us to deliver the Products to you or collect them from us.
      • you do not, within a reasonable time, allow us access to your premises to supply the Products
    • 8.2. You must compensate us if you break the contract. If we end the contract in the situations set out in clause 1 reasonable compensation for the net costs we will incur as a result of your breaking the contract depending on the date on which we end the contract, as compensation for the net costs we will incur as a result of your breaking the contract.
    • 8.3. We may withdraw the Product. We may write to you to let you know that we are going to stop providing the Product.
  4. If there is a problem with the Product
    • 9.1. How to tell us about problems. If you have any questions or complaints about the Product, please contact us. You can telephone our customer service team at +961 71 521 218 or by writing to us at info@getwabu.com.
    • 9.2. Damaged or Missing Products. Upon receipt of your order, please inspect the Products. If you receive a damaged Product, Wabu will replace such Product or issue a refund (including shipping charges) at no cost to you. Your purchases may arrive in multiple shipments. If all of your shipments have been delivered and you are still missing Products, please contact us on +961 71 521 218 or by writing to us at info@getwabu.com.
    • 9.3. Returns and Refunds. We accept returns and issue refunds for certain Products that are returned to us in an unused and re-saleable condition within five (5) days of receipt. Note that some Products are not eligible for return. You can find out if a Product is eligible for return by reviewing the Product description and/or your order confirmation email and/or contacting us on +961 71 521 218 or by writing to us at info@getwabu.com. Products marked “final sale” are not eligible for return. In the event that we issue a refund, we will credit the payment method you used to purchase the Product but note that we will not refund the original shipping fees. We may also charge return shipping and restocking fees, unless you opt to receive store credit in lieu of a refund.     • 9.4. Your obligation to return rejected Products. If you wish to exercise your rights to reject Products you must either return them in person to where you bought them, send them back to us or allow us to collect them from you. The Products must be in unused and in re-salable condition. For more on this please see our Shipping & Returns policy.
  5. Price and payment
    • 10.1. Where to find the price for the Product. The price of the Product (which includes VAT) will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of the Product advised to you is correct. However please see clause 5 for what happens if we discover an error in the price of the Product you order.
    • 10.2. Payment and Billing Information. By providing a credit card, store cash payments or other payment method that we accept, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your purchase (including any taxes and other charges). If the payment method cannot be verified, is invalid or is otherwise not acceptable, we will notify you and your order may be suspended or cancelled if you do not resolve the issue promptly.
    • 10.3. Change in payment information. In the event that you want to change or update payment information associated with your online Wabu account, you can do so at any time by logging into your account and editing your payment information. You acknowledge that the amount billed may vary due to promotional offers, changes to your order or changes in taxes or other charges, and you authorize us (or our third-party payment processor) to charge your payment method for the corresponding amount.
    • 10.4. We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the Product, we will adjust the rate of VAT that you pay, unless you have already paid for the Product in full before the change in the rate of VAT takes effect.
    • 10.5. What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the Products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the Product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the Product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order.
    • 10.6. When you must pay and how you must pay. You must pay for the Products when you order them.
    • 10.7. What to do if you think an invoice is wrong. If you think an invoice is wrong please contact us promptly to let us know. You will not have to pay any interest until the dispute is resolved. Once the dispute is resolved we will charge you interest on correctly invoiced sums from the original due date.
    • 10.8. If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection. 
    • 10.9. We accept payments online using Visa and MasterCard credit/debit card in USD (or any other agreed currencies).
    • 10.10. Refunds will be done only through the Original Mode of Payment
  6. Our responsibility for loss or damage suffered by you
    • 11.1. We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
    • 11.2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the Products.
    • 11.3. We are not liable for business losses. We only supply the Products for domestic and private use. If you use the Products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  7. How we may use your personal information
    • 12.1. How we may use your personal information. We will only use your personal information as set out in our privacy policy.
    • All credit/debit cards detail and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties. 
  8. Other important terms
    • 13.1. We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organization. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
    • 13.2. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
    • 13.3. Restrictions. You are expressly and emphatically restricted from all of the following:
    • 13.3.a. publishing any Website material in any media.
    • 13.3.b. selling, sublicensing and/or otherwise commercializing any Website material.
    • 13.3.c. publicly performing and/or showing any Website material.
    • 13.3.d. using this Website in any way that is, or may be, damaging to this Website.
    • 13.3.e. using this Website in any way that impacts user access to this Website.
    • 13.3.f. using this Website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Website, or to any person or business entity.
    • 13.3.g. engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website, or while using this Website.
    • 13.3.h. using this Website to engage in any advertising or marketing.

Certain areas of this Website are restricted from access by you and Wabu may further restrict access by you to any areas of this Website, at any time, in its sole and absolute discretion.  Any User ID and password you may have for this Website are confidential and you must maintain confidentiality of such information.

The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore, the Customers’ are encouraged to frequently visit these sections in order to be updated about the changes on the website. Modifications will be effective on the day they are posted.

www.getwabu.com will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of Lebanon.

  • 13.4.a. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
  • 13.4.b. Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of Lebanon.

  • 13.5. Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Products, we can still require you to make the payment at a later date.

  • 13.6. Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by Lebanese law and you can bring legal proceedings in respect of the Products before the Lebanese courts.
  • 13.7. Indemnification. You hereby indemnify to the fullest extent Wabu from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these terms and conditions.
  1. Variation of Terms. Wabu is permitted to revise these terms and conditions at any time as it sees fit, and by using this Website you are expected to review our terms and conditions on a regular basis to ensure you understand all terms and conditions governing use of this Website.
